Mihir Shah, the primary suspect in the BMW hit-and-run case, has petitioned the Bombay High Court alleging illegal detention and has demanded his immediate release.
Shah was apprehended on July 9, following a charge of hitting a two-wheeler in Mumbai's Worli area, resulting in the death of Kaveri Nakhwa (45) and injuries to her husband, Pradeep.
In his habeas corpus petition filed last week, Shah claims his arrest is unlawful and seeks a quash of the remand orders. He asserts that his prolonged detention violates constitutional mandates and urges the court to declare his arrest illegal. The hearing by the division bench of Justices Bharati Dangre and Manjusha Deshpande is set for Wednesday.
