A higher court has overturned a magisterial order critiquing Delhi Police's alleged negligence in an incident where an accused, Ahmed Salman, escaped custody. The court ruled the magistrate's remarks were hasty and lacked supporting evidence.
Additional Sessions Judge Vishal Singh was hearing a revision petition by the station house officer (SHO) of Lodhi Colony police station, who challenged the magistrate's orders from May 6 and May 17. The prosecution contended that a departmental inquiry was already underway, and an FIR had been registered immediately after the escape.
The court emphasized that the rapid re-arrest of Ahmed Salman and the ongoing inquiry by a senior officer made the magistrate's additional supervision unnecessary. Consequently, the court set aside the magistrate's orders, calling them unreasonable.
