The central Delhi District Consumer Dispute Redressal Commission has mandated United India Insurance to reimburse Rs 13,525 for medical expenses to a consumer, emphasizing that a 24-hour hospitalisation rule must be interpreted in line with emergency cases.
The decision came after Raja Harpal Singh's mediclaim for his wife's emergency hospitalisation was rejected due to a stay of less than 24 hours. The commission accused the insurer of causing mental distress, awarding Singh Rs 5,000 in compensation.
Highlighting advances in medical technology, the commission argued that adherence to the traditional 24-hour rule was unwarranted. They stressed that interpreting insurance policy clauses should consider modern medical practices and patient needs, ultimately concluding the claim's rejection was unjustified.
