Rajya Sabha Chairman Jagdeep Dhankhar emphasized that the jurisdiction to impeach a high court judge lies solely with Parliament. His assertion came as the motion for removing Justice Shekhar Yadav of the Allahabad High Court is currently under review.
The impeachment notice, signed by 55 upper house members, accuses Justice Yadav of making controversial remarks during a Vishwa Hindu Parishad (VHP) event. The notice, submitted in December 2024, indicates that his actions suggested communal bias, violating constitutional provisions.
Political figures like Kapil Sibal and Digvijaya Singh are among those who signed the motion, which was formally moved under legal frameworks, including the Judges' (Inquiry) Act, 1968, and Article 218 of the Constitution. The Supreme Court is also engaged, having sought an explanatory report from the Allahabad High Court's chief justice.
