The Supreme Court on Thursday reprimanded a private firm involved in a dispute over the construction of a five-star hotel in South Delhi, accusing it of 'forum shopping'. The term denotes litigants choosing courts they believe will favorably judge their case.
The bench, led by Justices Surya Kant and Ujjal Bhuyan, resolved a legal battle that spanned over three decades, originating from contractual obligations concerning a hotel project initiated by the Ministry of Urban Development in 1990. The court ordered the Housing and Urban Development Corporation Limited (HUDCO) to refund over Rs 28 crore to the firm but denied the firm 16% interest due to attempts to manipulate the judicial process.
The ruling highlighted HUDCO's failure to meet several contractual obligations, but also condemned the firm's conduct as undermining judicial integrity. The Supreme Court noted the importance of litigants approaching courts with transparency and good faith, emphasizing that legal processes should not be exploited for personal gain.
