High Court Demands Answer on Interstate Arrest Protocol Violation

The Delhi High Court has ordered the Greater Noida police commissioner to provide a report on the arrest of a Delhi resident by UP Police without informing Delhi Police. The court asserted this breach of protocol requires scrutiny, emphasizing the necessity of adherence to inter-state arrest procedures.

The Delhi High Court issued a directive to the Greater Noida police commissioner to file a report regarding the arrest of an individual in the national capital by UP Police, executed without notifying the Delhi Police. The court stressed the imperative of observing protocols for inter-state arrests.

A bench comprising Justices Prathiba M Singh and Dharmesh Sharma highlighted the urgency of following established procedures in such cases, calling the incident concerning. Both UP and Delhi police forces must clarify their positions on accusations that UP Police entered the capital and detained a resident unlawfully.

The court ordered an inquiry into which police officials participated in the arrest and the nature of the vehicle used. Notably, the petitioner, represented by advocate Vishal Gosain, was apprehended on February 18 but released the following day. The judiciary deemed the procedure of arrest prima facie illegal, requesting further investigation and a report by May 5.
