Supreme Court Clarifies Stance on Allahabad HC Judge's Decision

The Supreme Court has removed its criticisms of Allahabad High Court Judge Prashant Kumar, who permitted criminal proceedings in a civil dispute. The top court stressed the importance of maintaining judicial dignity and highlighted its role in upholding the rule of law. This resolution followed a request from Chief Justice B R Gavai.

The Supreme Court has retracted its earlier critiques of Allahabad High Court Judge Prashant Kumar regarding his decision to allow criminal proceedings in what was deemed a civil dispute. The apex court clarified that its previous remarks were intended to uphold the judiciary's dignity, not to disparage Judge Kumar.

Initially, a bench comprising Justices J B Pardiwala and R Mahadevan observed that such decisions might constitute an abuse of legal protocol, emphasizing the judiciary's role in maintaining the rule of law. However, following a request from Chief Justice of India B R Gavai, the Supreme Court reconsidered its stance, officially amending its observations.

The Supreme Court underscored the importance of high courts aligning with its broader aims, stating that high courts are not isolated entities. The court entrusted Allahabad High Court's chief justice to appropriately address the matter, ensuring institutional credibility while avoiding any perceived overreach.
