Limited Public Access Granted in DLF Chhatarpur Farms Roads Dispute

The Delhi High Court has approved limited public access through DLF Chhatarpur farms’ internal roads. The revision of an interim order came after an appeal from the Chhatarpur Farm Welfare Society. The court granted access from Gate 1 to 3, excluding commercial vehicles, from 5 am to 11 pm.

The Delhi High Court has approved limited public access through the internal roads of DLF Chhatarpur farms, a decision made after revisiting a previous interim order. This development comes as a response to an ongoing legal dispute with the Chhatarpur Farm Welfare Society, represented in court by senior advocate Rajshekhar Rao.

Initially, a single judge had granted unrestricted public access, which led to an appeal by the society. The roads in question are reportedly private, having been constructed by farm owners who handed over maintenance to a cooperative society. The petitioners, however, argue that these roads are public and should remain accessible.

The court's decision enables residents' access between Gates 1 to 3 daily, from 5 am to 11 pm, for non-commercial vehicles and essential services, while maintaining restrictions on commercial traffic. The court emphasized the need to reconsider the status of these roads under the DMC Act's definitions of private and public streets.
