The Indian IT ministry has implemented amendments to the IT Rules to refine the process for social media content takedowns. Under the new regulations, only high-ranking officials are authorized to request the removal of 'unlawful information' on digital platforms.
These amendments demand that detailed reasons and specific content details be provided for takedown requests. Monthly reviews by a government officer at the secretary level or higher are now mandated to ensure all actions remain within legal bounds and are proportionate and necessary.
The reform aims to enhance transparency and accountability in the removal process, balancing citizens' constitutional rights with regulatory powers. The changes are expected to prevent arbitrary restrictions and reinforce the principles of natural justice under the IT Act, 2000.
