The Motor Accident Claims Tribunal (MACT) in Thane has ruled in favor of the family of Daulat Waman Davane, awarding them Rs 40.08 lakh following his death in a road accident in 2018.
Davane, a 38-year-old plumber, was killed when struck by a speeding car on the service road of the Mumbai-Nashik Highway. A case was registered under the Indian Penal Code and Motor Vehicles Act at the time.
In its decision made public on Saturday, Judge KP Shrikhande accepted evidence provided by the deceased's wife, Darshana Davane, dismissing the insurer's allegations of negligence and breach of policy. The court calculated the family's loss of dependency at Rs 37.80 lakh, with a 20% enhancement, granting Rs.40.08 lakh compensation with 9% annual interest.
