The decision was made by a 2-1 vote from the 3rd U.S. Circuit Court of Appeals.
The appeals court concluded Khalil's claims should have been addressed through an immigration judge's removal order appeal under the Immigration and Nationality Act. Khalil, known for his campus activism, is one of several foreign students detained last year. The verdict could potentially restrict legal challenges to deportation orders if upheld.
