High Court Orders Immediate Release of Jailed Husband

The Allahabad High Court has ordered the release of Tahir alias Babloo, held in civil prison for 22 months for failing to pay maintenance. The court found the punishment excessive since the law mandates a maximum of one month per unpaid month without sufficient cause.

In a significant legal development, the Allahabad High Court has instructed the immediate release of a man held in civil prison for nearly two years. Tahir alias Babloo, was jailed following his failure to pay maintenance to his wife, despite the family court's directive.

Justice Praveen Kumar Giri ruled that there was no need for bail bonds or sureties for Tahir's release, as he was detained in civil prison. The court communicated its instructions promptly to jail authorities for swift action.

The case stemmed from an application by Tahir's wife seeking unpaid maintenance, totaling Rs 2,64,000. The family court had previously sentenced Tahir to a 22-month term, corresponding to the unpaid months. The High Court's intervention follows arguments that a civil prison term beyond one month is unwarranted without exploring other methods like property attachment.
