The Supreme Court has dismissed an appeal by the Madhya Pradesh Road Development Corporation Ltd (MPRDC) against an arbitral award that sided with Jabalpur Corridor Pvt Ltd (JCPL). The case related to a 2003 road project agreement that faced delays due to the state's failure to provide necessary land.
In a firm decision, the bench criticized the MPRDC's actions during the lengthy arbitration battle. The Supreme Court directed that the deposited amounts, along with accrued interest, be released to JCPL, highlighting the significant delay impairing swift justice. The court emphasized the crucial nature of limiting judicial interference in arbitration proceedings.
The tribunal awarded JCPL in 2014, but legal battles continued until the court's recent ruling, which condemned the MPRDC's approach to delay contractual obligations as "deplorable." The emphasis was on ensuring that arbitration remains an efficient system for resolving disputes in India.
