President Ramaphosa Receives Second Interim Report on SAPS Inquiry

According to the Presidency, the latest report reviews the recommendations and referrals made in the first interim report relating to SAPS.

South African President Cyril Ramaphosa has received the second interim report from the Judicial Commission of Inquiry into Criminality, Political Interference and Corruption in the Criminal Justice System, with its latest recommendations set to support ongoing investigations by a South African Police Service (SAPS) special task team.

The Presidency said the report, prepared by the Commission chaired by Acting Deputy Chief Justice Mbuyiseli Madlanga, was submitted on 29 May 2026. It follows the first interim report presented in December 2025 as part of the inquiry into allegations that emerged from claims made by Lieutenant-General Nhlanhla Mkhwanazi in July 2025.

Commission Reaffirms Earlier Recommendations

According to the Presidency, the latest report reviews the recommendations and referrals made in the first interim report relating to SAPS. After hearing evidence from individuals implicated during the inquiry, the Commission has reaffirmed almost all of its earlier findings, with only one recommendation being treated differently.

The report also introduces new recommendations based on evidence presented before the Commission since the beginning of 2026. These findings are intended to strengthen ongoing investigations and ensure that matters requiring urgent attention are addressed without delay.

Investigations Recommended Against Four Individuals

Based on the evidence gathered so far, the Commission has recommended disciplinary proceedings and immediate criminal investigations involving four individuals. Those named are Lieutenant General Shadrack Sibiya, Witness G, Sergeant Fannie Nkosi and Brown Mogotsi.

The Commission has advised that criminal proceedings should be considered if investigators find sufficient evidence after completing their inquiries. It has also called for an immediate investigation into alleged off-the-books Crime Intelligence operations involving Brown Mogotsi and Witness G.

The Presidency said this investigation should be conducted by the Office of the Inspector General for Intelligence or another authority with the legal powers to carry out the inquiry.

Referrals to Support Ongoing Police Investigations

The Presidency said the Commission's recommendations have been made in line with its Terms of Reference, which allow it to refer matters for urgent criminal investigation, prosecution or additional inquiries where necessary.

The latest referrals will now become part of the work being carried out by the SAPS special investigations task team that was established after the first interim report. The task team is responsible for investigating individuals identified by the Commission and ensuring that cases requiring urgent action are properly examined.

The Judicial Commission is expected to complete its work later this year, with its final report scheduled to be submitted to President Ramaphosa on 16 November 2026.
