The Delhi High Court has prompted the Law Commission to review and consider amendments to current disability laws, ensuring unfilled positions in higher educational institutions roll over to the subsequent academic year. This motion seeks to address a significant gap in the Rights of Persons with Disabilities (RPwD) Act provisions.
A bench comprising Chief Justice D K Upadhyaya and Justice Tushar Rao Gedela underscored the importance of establishing a legal framework to redirect such seats exclusively for individuals with disabilities, thus aligning with the RPwD Act's objectives.
The decision came in response to a petition by Jahanvi Nagpal, who pressed the government and National Medical Commission to secure her a position in the NEET-UG 2022 cycle under the disability category. The court's directive emphasized the necessity for the Union of India to robustly implement the RPwD Act.
