In a recent ruling, the Mumbai court sentenced renowned filmmaker Ram Gopal Varma to three months of imprisonment, drawing attention to the prevalent issue of cheque dishonoring. The court deemed Varma guilty under the Negotiable Instruments Act for failing to fulfill financial commitments.
The Andheri Judicial Magistrate, Y P Pujari, delivered the verdict on January 21. Although Varma was absent during the ruling, the magistrate maintained that proceedings in the absence of the accused were legally permissible under the Code of Criminal Procedure. The court underscored that sufficient opportunity was provided to Varma to settle the dues.
Despite his attempts to seek suspension of the sentence through the sessions court, the judgment underlined the necessity of punishment to deter the "human tendency" of misusing cheques. The case emerged after Varma's cheques, issued to settle dues for services rendered, were dishonored, compelling legal action from the complainant.
