Tribunal Demands Fresh Review of MCD's Regularization Denial in Delhi

The Appellate Tribunal of the Municipal Corporation of Delhi (MCD), led by Additional District and Sessions Judge Abhilash Malhotra, has instructed the MCD to independently review a regularization application. The Tribunal emphasized that the review must remain uninfluenced by unauthorized constructions on other floors.

This directive comes in the wake of a legal challenge by Mrs. Gagandeep Kaur Bhasin, contesting the MCD's rejection of her third-floor property's regularization in Chittaranjan Park. The rejection was based on deviations existing on other floors owned by different individuals.

Despite reports acknowledging no unauthorized deviations on Bhasin's floor, the MCD dismissed the regularization plea. The Tribunal accused the MCD of 'deliberate dereliction of duty' for ignoring illegal constructions on lower floors. It urged an investigation into officials' conduct and directed adherence to building guidelines, mandating fair regularization practices.
