Delhi HC Upholds Fair Trial Over Speed in Riot Case

In a significant ruling, the Delhi High Court has prioritized fairness over speed in trial proceedings concerning the Delhi Riots case. The court permitted an accused, Mohd. Danish, to recall a prosecution witness, underscoring that justice should not be sacrificed for the sake of expedited trials.

The court suggested that while unnecessary delays must be avoided, providing sufficient opportunity for cross-examination is crucial, even if it calls for minimal adjournments. This decision highlights the necessity of balancing swift legal procedures with the rights of the accused to a fair trial.

Presiding over the case, Justice Anup Jairam Bhambhani pointed out that ensuring a fair trial is paramount. He noted the importance of allowing Danish to cross-examine a witness who recognized him in court despite not mentioning him during the initial investigation, stressing that this ensures a comprehensive and just evaluation of evidence.
