Plea in HC claims Director-in-Chief post in North DMC created illegally

A plea in the Delhi High Court on Thursday urged it to quash a notification issued by the North Delhi Municipal Corporation (NrDMC) creating the post of Director-in-Chief, claiming that it has been created ''illegally''.
A bench of Chief Justice D N Patel and Justice Jasmeet Singh issued notice to the Delhi government, NrDMC and the Union Public Service Commission (UPSC) seeking their response to the plea which has claimed that the post which was created as a stop-gap arrangement was not abolished after it served its purpose and was being extended ''illegally'' by the corporation.
The plea by an elected member of the NrDMC -- Rakesh Kumar -- has contended that the corporation ought to have laid down the recruitment rules for making the post in question a permanent one, but it was not doing so.
In his petition, filed through advocates Somya Singh, Mohd Juned and Pooja Gurjar, Kumar has sought quashing of the January 1, 2021 notification issued by the NrDMC creating/extending the post of Director-in-Chief.
The plea also seeks abolishing of the post claiming it was created illegally for over seven years from 2013 onwards by the NrDMC.
Apart from being illegally created, the post was also ''an additional burden on NrDMC both logistically and financially'', the petition has claimed.
It has also sought directions to the Delhi government, UPSC and the corporation to frame recruitment rules before creating any post for more than three years.
