The Congress launched an attack on former Chief Justice of India (CJI) D Y Chandrachud following his comments that bail should be the rule, not the exception, when swift trials are unfeasible. Congress spokesperson Supriya Shrinate questioned why Chandrachud did not act accordingly when he was in office, pointing to delays in activist Umar Khalid's bail applications.
In response to the Congress's criticism, BJP spokesperson Shehzad Poonawalla accused the opposition party of consistently undermining the judiciary and other constitutional institutions. Poonawalla suggested that Congress's actions reveal its tendency to support individuals involved in controversial and anti-national activities.
Chandrachud's remarks at the Jaipur Literature Festival came amid the backdrop of the Supreme Court's denial of bail to Umar Khalid in the 2020 Delhi riots conspiracy case. The Ex-CJI emphasized the importance of granting bail before conviction, except in cases where national security is at risk. He highlighted the need for courts to conduct thorough evaluations before making decisions on bail applications.
