A Delhi court has convicted a man, Sunil alias Golu, for instigating an associate to stab a police constable in 2016, amounting to an attempt to murder.

A Delhi court has convicted a man in a 2016 case involving an attack on two police personnel, saying that he instigated his associate to stab a constable with the intention to kill.

Additional Sessions Judge Subhash Kumar Mishra was hearing a case against Sunil alias Golu who was accused in a case related to assault, attempt to murder police officials and absconding during trial proceedings.

In an order dated May 21, the court said, ''If the testimony of such a witness is reliable, trustworthy, cogent and duly corroborated by other witnesses or admissible evidence, then the statement of such witness cannot be discarded only on the ground that he is a police officer and may have some interest in the success of the case.''.

The court said that the prosecution had proved beyond a reasonable doubt that Sunil and co-accused Pawan attacked two police officials who were discharging official duty and that the stabbing incident amounted to an attempt to murder.

''Co-accused Pawan, at the instigation of the accused and in furtherance of the common intention with him, stabbed Constable Vikram in his thigh and hip causing grievous injury, with an intention and knowledge that if the death of Ct. Vikram would have been caused, he would have been guilty of murder,'' the court said.

Pawan was already convicted in October 2022.

According to the prosecution, on February 11, 2016, constables Kavinder and Vikram Bhati were headed towards Chand Cinema in Trilokpuri to verify information about the presence of a proclaimed offender when they narrowly escaped a collision with Sunil, who was allegedly riding his motorcycle at high speed from the wrong side.

An altercation followed after the police personnel advised him to drive carefully. The prosecution alleged that despite being informed they were police officials on duty, Sunil hit himself on the head with a brick and summoned his associate Pawan and others.

''Accused Sunil alias Golu stands convicted for the commission of the offence punishable under IPC Section 333 (voluntarily causing hurt), 307 (attempt to murder), 353 (Assault or criminal force to deter public servant from discharge of duty) read with 34 (common intention) and under Section 174A IPC,'' the court said.

The court noted that Pawan subsequently arrived with a knife and stabbed Vikram Bhati multiple times. It observed that one of the injuries was life-threatening because it could have caused rapid blood loss through damage to the femoral vein.
