The Delhi Police has approached the High Court seeking the cancellation of bail for a teacher involved in the alleged sexual assault of a toddler by a school staff member. The incident occurred within the premises of a private school in Janakpuri, west Delhi.
Justice Saurabh Banerjee has notified the teacher about the police's appeal against the trial court's decision to grant her bail on May 20 under the Protection of Children from Sexual Offences Act. The main accused, Lalit Kumar, will also need to respond to the same plea, with further court discussions slated for June 17 by a vacation bench.
The teacher was originally detained for allegedly failing to report the incident. Her arrest followed a police complaint made by the victim's mother, which detailed the child's account of the assault occurring in a secluded school area.
The case has invoked Section 64(1) of the Bharatiya Nyaya Sanhita and Section 6 of the POCSO Act, suggesting severe penalties for the offense. Despite the child's identification of Kumar, a court unexpectedly granted him bail, sparking further legal action by the prosecution.
