The court specifically criticized the state for overlooking Gurugram's existing infrastructure issues while trying to boost its revenue. It stated that the policy was implemented without conducting a necessary 'Infrastructure Capacity Audit,' which compromised Gurugram's urban environment.

During hearings, the court noted severe road narrowness and infrastructure lapses in Gurugram's Sector 28. In response, a commission has been tasked to evaluate the situation, reflecting the judiciary's emphasis on sustainable urban planning and public welfare.
