In a move impacting prisoner rights, the Delhi High Court has sought responses from the Delhi Government and the National Investigation Agency (NIA) over a plea filed by Masasasong AO. The petitioner challenged the denial of telephone and E-Mulakat facilities in Tihar Jail, arguing that such restrictions violate basic inmate rights.
Masasasong, accused of terror funding under the Unlawful Activities (Prevention) Act (UAPA), has been detained since 2020. His advocate, MS Khan, criticized a circular from NIA that mandates permission from investigating agencies for such facilities. Justice Sanjeev Narula has instructed both respondents to file their counter affidavits within three weeks.
In his plea, Masasasong highlighted the distress faced by his elderly parents and his need to communicate with his minor children. The NIA defended its stance, citing potential risks of witness tampering and evidence interference due to the ongoing trial. An addendum issued on June 12 further clarified the protocol for granting these facilities to inmates.
