A Mumbai court has ordered the repatriation of alleged gangster Kumar Pillai to Hong Kong, noting he was acquitted in all cases for which he was initially extradited. The ruling reflects a Supreme Court decision that bars further trial in India without the extraditing country's consent.
Judge Satyanarayan R. Navander emphasized that the prosecution must proceed with Pillai's return due to the absence of permission from Hong Kong to try him in other pending cases. Despite objections from the prosecution about unresolved cases, the court highlighted that no appeal has been filed against Pillai's acquittals.
The court's decision mandates the Mumbai police commissioner to ensure Pillai's repatriation, underlining the exhaustion of the extradition process initial purposes under Indian law. Pillai's counsel argued that his stay in India is unlawful since he is a Hong Kong citizen.
