High Court Grants Bail to Gym Trainer Amid Controversial Rape Allegations

The Delhi High Court, in a controversial decision, has granted bail to a married gym trainer accused of rape. The judge noted that the accused and the complainant seemed to share a consensual romantic relationship, challenging the prosecution's argument.

Justice Girish Kathpalia, on May 12, emphasized the need to separate morality from the legal assessment of individual liberty. Despite police opposition, the court allowed the bail, observing that evidence did not support the allegations of coercion or a drug-facilitated assault.

The court highlighted that the complainant, a 30-year-old practicing advocate, did not claim the relationship was built on false pretenses. The decision questions the prosecutrix's narrative of being sexually assaulted following an alleged drugging, given physical evidence to the contrary.
