A new academic study warns that subtle biases in AI systems could distort public discourse and undermine democratic processes. The research raises urgent questions about how existing laws can address this challenge. Their paper, titled “Communication Bias in Large Language Models: A Regulatory Perspective,” examines how the EU’s current legislative framework, particularly the AI Act, Digital Services Act (DSA), and Digital Markets Act (DMA), can be adapted to mitigate the risks.

The study underscores that while laws already target data governance, illegal content, and competition, they do not yet tackle the core threat posed by communication bias: the subtle shaping of opinions by AI systems that increasingly act as intermediaries in social, political, and cultural discourse.

LLMs as opinion gatekeepers

The authors argue that communication bias arises when AI systems, particularly LLMs, systematically favor certain viewpoints, often reflecting imbalances in their training data or reinforcing user preferences in ways that create echo chambers. The Digital Markets Act (DMA) contributes indirectly by targeting market concentration among dominant digital players. By encouraging competition and lowering barriers for new entrants, the DMA seeks to diversify the ecosystem of models and data sources. However, as The authors note, increased competition alone is insufficient to prevent biased outputs if all models are trained on similarly skewed datasets or optimized for user engagement rather than balanced representation.

The study stresses that without direct oversight of communication bias, even the most robust compliance and moderation efforts will fall short. The subtlety of the bias makes it harder to detect, regulate, and remedy, yet its cumulative impact on public discourse can be profound.

Pathways toward inclusive AI governance

To address these challenges, the researchers propose a multifaceted approach that combines regulatory reform, competitive diversification, and participatory governance. They call for regulators to broaden the interpretation of existing laws to treat communication bias as a central risk, warranting systematic auditing of how LLMs represent social, cultural, and political viewpoints.

The authors advocate for stronger measures to foster competition not only among providers but also among models with diverse design priorities and training data. A more pluralistic AI ecosystem could help mitigate the dominance of any single perspective and offer users a wider range of information sources.

Most importantly, the study points out the role of user self-governance. Empowering individuals to influence how their data is collected, how models are trained, and how outputs are evaluated can enhance the alignment of AI systems with societal expectations. This participatory approach would complement regulatory oversight by creating continuous feedback loops between users, developers, and regulators.

The study further recommends shifting from one-time compliance checks to continuous, market-centered governance. This would involve ongoing external audits, enforcement actions informed by user complaints, and adaptive rules that keep pace with rapid advances in AI technology.
