Supreme Court Reinstates Bihar Legislator, Citing Disproportionate Punishment

The Supreme Court overruled the expulsion of RJD MLC Sunil Kumar Singh from the Bihar Legislative Council, deeming the penalty disproportionate. In a significant ruling on Tuesday, the Supreme Court overturned the Bihar Legislative Council's decision to expel Rashtriya Janata Dal (RJD) MLC Sunil Kumar Singh. The court considered the punishment for Singh's alleged defamatory remarks against Chief Minister Nitish Kumar to be excessive and ordered his reinstatement.

This decision comes after Singh was removed by the legislative council Secretariat in July 2024. The expulsion was a consequence of remarks made during a February 2024 address by the Governor, following the formation of a new alliance government between the JDU and BJP.

While the court found Singh's comments objectionable, it emphasized the excessive nature of the punishment. The verdict also addresses the scope of judicial review over House regulations, highlighting that courts can assess the proportionality of legislative penalties.
