Delhi High Court Penalizes Petitioner for Judicial Misuse in Rohini Construction Case

The Delhi High Court criticized a petitioner for abusing the judicial process through multiple writ petitions against alleged illegal constructions in Rohini. In a significant ruling, the Delhi High Court has found a petitioner guilty of misusing the judicial process by repeatedly filing writ petitions concerning alleged unauthorized constructions in Rohini without properly following through on them.

Justice Mini Pushkarna identified the petitioner's non-bona fide intentions, noting five similar petitions he had previously filed regarding different properties in the same area. The court remarked that the petitioner either failed to pursue these petitions or withdrew them, claiming the property owners had begun self-rectifying.

Recognizing a pattern of filing and neglect, the High Court stated the actions demonstrated a clear misuse of writ jurisdiction, driven by ulterior motives. A punitive cost of ₹50,000 was imposed on the petitioner to deter future misuse, while directing the Municipal Corporation of Delhi to continue addressing illegal constructions independently of the petitioner's actions.
