Supreme Court Boosts Homebuyers' Hope with NBCC Mandate

The Supreme Court has delivered a significant ruling to expedite the delivery of homes to thousands of waiting buyers by endorsing the National Company Law Appellate Tribunal's (NCLAT) directive. This ruling mandates the State-owned National Buildings Construction Corporation (NBCC) to swiftly complete 16 housing projects initiated by the financially distressed realty firm, Supertech Limited.
A bench led by Chief Justice Surya Kant and Justice Joymalya Bagchi exercised its special authority under Article 142 of the Constitution to enforce the NCLAT's decision from December 12, 2024. This decision is seen as a crucial step toward fulfilling the long-overdue housing commitments made to approximately 51,000 families who secured homes with Supertech over a decade ago.
The court's order places homebuyers' needs at the forefront, instructing that all promised amenities like water, electricity, and neighborhood facilities must be ensured. While Supertech's financial creditors must adjust expectations regarding dues, the emphasis remains firmly on meeting the housing promises through NBCC's management, as backed by an NCLAT-appointed expert committee.
