Delhi High Court Rules on RTI and Personal Information

The Delhi High Court determined that an individual cannot request information about their spouse's income through an RTI application. This decision came after a woman argued that the data was crucial for adjudicating her maintenance claim.

Justice Purushaindra Kumar Kaurav stated that personal details, including income tax returns, are exempt from disclosure under Section 8 (1)(j) of the RTI Act unless they serve the public interest. The ruling followed a challenge to a Central Information Commission order that had directed the release of a husband's income information for financial year 2007-2008.

The court emphasized that the RTI Act aims to enhance transparency in public authorities, not to disclose personal information unrelated to public welfare. It also pointed out alternative legal avenues for addressing maintenance claims, where both parties must disclose income, assets, and liabilities through affidavits.
