The Supreme Court on Monday requested responses from the Delhi government and BJP leader Rajiv Babbar following a plea from Delhi Chief Minister Atishi and AAP leader Arvind Kejriwal. The plea challenges a high court decision that denied quashing a defamation case against them.
A panel of Justices Hrishikesh Roy and SVN Bhatti issued a notice and halted trial court proceedings. Senior advocate Abhishek Singhvi, representing Atishi and Kejriwal, argued that the defamation case filed by Babbar is unwarranted, as he is not the individual alleged to have been defamed.
Sonia Mathur, representing Babbar, explained that the BJP leader filed the defamation case on the party's behalf. Atishi and Kejriwal's challenge follows a September 2 high court order which claimed their comments prima facie defamed the BJP, intending to tarnish its image and gain political mileage.
