Key Congress figures, including National President Mallikarjun Kharge and LoP Lok Sabha Rahul Gandhi, are set to convene at Kharge's residence to address the fallout from the Supreme Court's decision to exclude the creamy layer of SC/ST from reservations. The meeting is scheduled for 6:30 pm.
The Supreme Court, in a landmark 6:1 ruling on August 1, granted states the authority to sub-classify SCs and STs. The decision emphasized that the adequacy of representation should be based on effectiveness rather than quantitative measures. Chief Justice of India DY Chandrachud led the seven-judge bench that issued the ruling, overturning a previous judgement from the EV Chinnaiah case.
Justices BR Gavai, Vikram Nath, Bela M Trivedi, Pankaj Mithal, Manoj Misra, and Satish Chandra Sharma were part of the bench. Justice BR Gavai recommended that states formulate a policy to identify and exclude the creamy layer within SCs and STs from affirmative action benefits. However, Justice Bela M. Trivedi dissented, disagreeing with the majority's stance on sub-classification. Union Minister Chirag Paswan and RJD MP Manoj Jha voiced their opposition to the ruling, with Paswan's party planning to file a review petition.
