In a significant development, the Rouse Avenue Court on Saturday granted probation to former MLA Alka Lamba, convicted in a protest case related to the Women's Reservation Act. The protest took place at Jantar Mantar in July 2024, resulting in her conviction and subsequent plea for release based on good conduct.
The court, presided over by Additional Chief Judicial Magistrate (ACJM) Ashwani Panwar, directed Lamba's release on probation for one year. This decision requires her to submit a bond of Rs 1 lakh, along with a surety bond of the same amount, emphasizing the court's interest in justice and Lamba's clean track record.
The judgment underscored the court's belief in rehabilitation over punishment, citing the Reformative Theory of Punishment. Notably, despite the potential risks posed by Lamba's actions during the protest, no physical harm occurred. The court acknowledged her first-time offender status and absence of prior convictions, granting leniency under benevolent legal provisions.
