The Bharatiya Janata Party (BJP) on Thursday charged the AAP government with violating constitutional provisions by failing to constitute the sixth Delhi Finance Commission.
The tenure of the Fifth Delhi Finance Commission ended on March 31, 2021. According to BJP MLA Vijender Gupta, the sixth commission should have been formed since April 2021.
''The commission's importance is heightened now that the Delhi Municipal Corporation is no longer trifurcated,'' said Gupta at a press conference. A letter has been sent to the Delhi Lt Governor seeking intervention. If needed, BJP leaders will meet the President to demand the AAP government's dismissal over the constitutional violation.
Article 243(I) of the Constitution mandates forming a State Finance Commission every five years, while Article 243(Y) requires it to review municipalities' financial positions and make recommendations. Gupta also highlighted that the Delhi government had accepted but failed to implement the Fourth Delhi Finance Commission's recommendations, continuing to allocate funds based on the Third DFC's recommendations.
