The Delhi High Court is set to pass its order today on a plea by Chief Minister Arvind Kejriwal's aide, Bibhav Kumar, who is challenging his arrest connected to the alleged assault on AAP MP Swati Maliwal.
Justice Neena Bansal Krishna will pronounce the order at 2:30 pm, according to the court's official schedule.
Kumar's counsel has argued that the arrest was illegal due to a delay in filing the FIR, with Kumar being detained on May 18 after he had voluntarily joined the investigation. The police opposed the plea, asserting that the arrest was not conducted in haste and adhered to legal protocol.
The court reserved its decision on the plea on July 8 after hearing submissions from both sides. Currently in judicial custody, Kumar allegedly assaulted Maliwal at Kejriwal's residence on May 13 and was arrested five days later. The FIR, filed on May 16, includes charges of criminal intimidation, destruction of evidence, and attempts to commit culpable homicide.
Kumar's bail plea was previously denied by both the trial court and the high court, and it is now pending before the Supreme Court.
