The Supreme Court of India on Monday highlighted the 'alarming increase' in acid attack cases, urging the government to consider stricter penalties for offenders. The court suggested that the burden of proof be shifted to the accused to demonstrate innocence, diverging from typical criminal jurisprudence norms.
The bench also ruled that pending formal amendments, those forcibly made to consume acid should be recognized under the Rights of Persons with Disabilities Act, 2016. This move aims to ensure that such victims can access essential welfare services. The court emphasized the urgent need to regulate acid sales in the market.
Justice was sought through a PIL by acid attack survivor Shaheen Malik, who argued for victims to be categorized as disabled to access welfare provisions. The Supreme Court's concerns included the existing punishment's inadequacy in deterring such brutal acts and proposed asset attachment for convicts to aid victim compensation.
