Former Chief Justice of India, B R Gavai, sparked a contentious debate during a lecture at Mumbai University by advocating for the application of the 'creamy layer' principle to reservations for Scheduled Castes. This stance, Gavai disclosed, brought criticism from his own community, echoing historical tensions surrounding affirmative action policies.
Recalling Dr. B R Ambedkar's analogy of affirmative action as a bicycle for those trailing behind, Gavai questioned if Ambedkar intended beneficiaries to remain dependent indefinitely. He argued that Ambedkar's vision sought genuine social and economic justice, not merely formal equality.
In discussing his controversial judgement inspired by the Indra Sawhney case, Gavai emphasized the exclusion of economically advanced individuals from affirmative action but faced backlash. Despite these challenges, he recognized the positive role affirmative action has played in uplifting marginalized societies across India.
