Supreme Court Revives Retrospective Environmental Clearances
The Supreme Court has recalled its May 16 ruling against retrospective environmental clearances. This decision allows projects that breached environmental norms to receive approvals upon paying penalties. This prevents the demolition of numerous vital public projects worth thousands of crores, safeguarding public interest and addressing previous judicial oversights.

In a pivotal decision, the Supreme Court has withdrawn its previous ruling against retrospective environmental clearances, following a 2:1 majority decision. This move permits the continuation of vital projects by granting approvals, contingent on heavy penalties for those previously found in violation of environmental norms.
The court's verdict, defended by Chief Justice of India B R Gavai and Justice K Vinod Chandran, counteracts potential stalling or demolition of key public projects, averting economic ramifications amounting to thousands of crores. Their judgments noted previous oversight of essential legal precedents.
Projects such as an AIIMS facility in Odisha and a greenfield airport in Karnataka are saved from possible demolition. The court emphasized a balanced approach, ensuring adherence to environmental laws while recognizing the public interest at stake.
